Article 1 | Applicability and Agreement of Terms of Use

The mobile app you (the "User" or "you") have downloaded, "Sharish," is offered by Happy Ventures B.V., located in the Netherlands (referred to as “Sharish,” "we," or "us"). The Sharish app (the "App") is designed to help Users track items, such as books, that are lent to or borrowed from others, and manage records of these loans.

These Terms of Use, along with our Privacy Policy, govern all uses of the App. By creating an account and using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree with any of these terms, you must discontinue using the App immediately.

These Terms of Use remain effective for as long as you use the App. Should Sharish restrict or terminate your account, these terms will continue to govern your prior interactions with the App.

 

Article 2 | License of Mobile App

We grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on devices owned or controlled by you, solely in compliance with these Terms of Use.

 

Article 3 | User Representations

By using the App, you agree that:

1. The registration information you provide is accurate and complete.
2. You will promptly update your information as necessary.
3. You are legally eligible to use the App in your jurisdiction.
4. If you are under the age of majority, you have parental permission to use the App.

 

Article 4 | User Registration

You must create a personal account to use the App. You are responsible for maintaining the confidentiality of your password and for all activities under your account. Notify us immediately if you believe your account security has been compromised. Sharish reserves the right to block or remove any account at its discretion.

 

Article 5 | User-Generated Contributions and License

The App may allow you to submit content, such as book or item information, to facilitate lending and borrowing. By using this functionality, you grant us a non-exclusive, royalty-free, worldwide license to use, store, display, and distribute such content as part of the App's core functionality.

Your contributions must not infringe on the rights of others or violate any applicable laws. Sharish reserves the right to remove or restrict any content that violates these guidelines or is deemed inappropriate.

 

Article 6 | Use of the App

The App and its content are provided "as is." You are responsible for ensuring that your use of the App is legal in your jurisdiction and for any associated internet costs.

 

Article 7 | Prohibited Activities

As a User of the App, you agree not to:

• Collect user data without permission.
• Circumvent the App’s security features.
• Disrupt the App’s functionality or networks.
• Reverse-engineer any part of the App.
• Use the App in any manner that violates applicable laws.

 

Article 8 | Privacy

We value your privacy. Please review our Privacy Policy to understand how Sharish collects, uses, and protects your data. By using the App, you agree to our Privacy Policy.

 

Article 9 | Disclaimer and Liability

Sharish aims to provide optimal access to the App but does not guarantee its continuous availability or error-free performance. Use of the App is at your own risk. To the fullest extent permitted by law, Sharish disclaims all warranties and will not be liable for any damages arising from use of the App, including data loss or interruptions.

 

Article 10 | Indemnification

You agree to defend, indemnify, and hold Sharish harmless from any loss, liability, or claim arising from your use of the App, your contributions, or your breach of these Terms of Use.

 

Article 11 | Intellectual Property Rights

All content, software, and trademarks within the App are owned by or licensed to Sharish and are protected by copyright and other intellectual property laws. No part of the App may be used, copied, or exploited for commercial purposes without prior written permission.

 

Article 12 | Third-Party Services

The App may include links to or integrations with third-party services, governed by those third parties' policies. Use of such services is at your own risk.

 

Article 13 | Modifications

Sharish reserves the right to modify these Terms of Use. If you do not agree to the changes, you may discontinue use of the App.

 

Article 14 | Miscellaneous

Failure by Sharish to enforce any right or provision in these Terms does not constitute a waiver of such right or provision. If any part of these Terms is found unenforceable, the remaining terms will continue in effect.

 

Article 15 | Governing Law and Disputes

These Terms of Use are governed by the laws of the Netherlands. Any disputes that cannot be resolved amicably may be submitted to the competent Dutch court.
